QReady (ABN: 38 447 206 504) is committed to providing quality services to you and this policy outlines your ongoing obligations in respect of how you access and use our services (referred to throughout the following as 'qready', 'this', 'website' or 'service'). 'We'. 'us' and 'developers' refers to QReady.
Our responsibilities
We aim to provide software without defect to you, the user. If at any time, major issues arise, we shall act as soon as possible to notify you wherever possible and rectify the issue as quickly as possible. However, no liability for loss, damage or injury resulting from the use of this software will be accepted by us, as it is provided "as is" to you.
Your responsibilities
We require you to use this software in a 'fair' and 'reasonable' manner. This prohibits unauthorised access of any back end, attempting to slow or crash the servers where our services are hosted, sharing of any confidential information that you may posses relating to our app or web service, although this is not an exhaustive list. Any intentional misuse constitutes a breaking of this agreement and we will be compelled to take action against those involved. This expressly permits us to disclose and share any information (personal or technical) we may hold relating to you with other organisations including but not limited to legal firms, secutity firms and law enforcement agencies.
Privacy
We strive to maximise the security of your data and wil not disclose, share or sell your personal information to third-parties except in the process of providing you the service (as well as legal or law enforcement agencies, where required). However you acknowledge by using this service that we may collect and store personal and techincal information, and that you will not hold us responsible for any compromises in the integrity of our security measures that may allow access to sensitive information. Termination
Either party may terminate this agreement at anytime. We may close, suspend, delete or modify your account in any way and at any time. You may contact us, via email and request your account to be closed, which will be carried out within a reasonable timeframe. A final invoice may be calculated and provided to you for payment of any outstanding services rendered. Non-payment of this may lead to the commencement of legal / debt recovery action
Limitation of liability
Under no circumstances shall QReady be liable to you or any party related to you for any indirect, incidental, consequential, special, exemplary, or punitive damages or loss of profits, even if QReady has been advised of the possibility of such damages. While we will attempt to minimise and mitigate all risks, we are in no way liable for injury or death that occurs as a result of your use of our services or in connection with them to the maximum extent permitted by law.
Severability
The invalidity or unenforceability of any provisions of this Agreement shall not affect the validity or enforceability of any other provision of this Agreement, which shall remain in full force and effect.
Business / Developer partnerships
Should you be interested in making use of or referring to our products/services, for commercial purposes (defined here to be a use which directly or indirectly could be seen to be generating revenue for you) we require express written permission to be obtained from us beforehand. Copyright / legal
QReady is under the Australian Copyright Act 1968 and express written permission is required prior to any commercial use of it to the extent provided by this act. If you wish to seek this approval, please contact us using the form provided on this website.
Any dispute, controversy or claim arising out of, relating to or in connection with this contract, including any question regarding its existence, validity or termination, shall be resolved by negatiotions between you and QReady. The governing law any and all arbitration and legal proceedings shall be that of the state of New South Wales and Commonwealth of Australia.
